The petitioner has prayed for bail in connection with Bodhgaya P.S. Case No. 68 of 2013 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307, 302, 333, 337, 338, 322, 224, 225, 353, 120-B and 379 of the Indian Penal Code.

As per the the allegation in the FIR, while the informant was taking the FIR named accused persons in custody to the police station, a large number of persons are alleged to have raised hulla and created chaos. It is submitted by learned counsel for the petitioner that name of this petitioner transpired in course of investigation only on the basis of suspicion of having been a member of the

It is further submitted that similarly situated co-accused persons have been granted bail. Some of the orders have been brought on record as Annexure-2 series to the application.

Having heard learned counsel for the parties and taking into consideration that similarly situated co-accused persons have been granted bail by order dated 04.02.2019 passed in Cr. Misc. No. 6095 of 2019 as contained in Annexure-2 to the application and the petitioner is in custody since 19.02.2019, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 3rd, Gaya in connection with Bodhgaya P.S. Case No. 68 of 2013.
