JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner and co-accused are said to have made indiscriminate firing causing death of informant's father on the spot.

Submission on behalf of the petitioner is that in course of investigation, not a single witness stated about the firing made by the petitioner but I am not, at all, convinced with the aforesaid submission and taking note of allegation as well as criminal antecedent of the petitioner, the prayer for bail of the

Patna High Court Cr.Misc. No.46207 of 2016 (4) dt.05-12-2016 2/2 petitioner in connection with Mairwa P.S. Case No. 119 of 2015 pending in the court of Chief Judicial Magistrate, Siwan stands rejected.

However, the trial court should expedite the trial of the petitioner.
