The petitioners Jai Ram Thakur and Indrajit Singh apprehend their arrest in a case registered under Sections 406, 409, 420/34 of the Indian Penal Code in connection with Ara Muffasil P.S. Case No. 209 of 2014.

The BDO alleged that the petitioner purchased solar lights at a higher price than the price fixed by BIADA. Learned counsel for the petitioners submits that the solar lights were purchased from different companies after following due process of advertisement and inviting tender. The petitioners are Panchayat Secretaries.

Learned APP did not dispute the facts.

Patna High Court Cr.Misc. No.51904 of 2014 (2) dt.05-01-2015 Having considered the facts aforesaid that the solar lights were purchased after following due process, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Ashok Kumar Manjhi, the learned Judicial Magistrate 1st Class, Bhojpur at Ara in connection with Ara Muffasil P.S. Case No. 209 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
