JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Garhpura P.S. Case No. 47 of 2019 for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016 and Sections 25 (a-b)A/26 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 12.04.2019. He further submits that in the instant case total 375 ml of foreign liquor as well as one Desi Katta was seized.

Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than 2 1⁄2 months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees
