The petitioner apprehends his arrest in Jogbani (Bathnaha) P.S. Case No. 47 of 2014, registered for the offences punishable under Sections 363, 365 and 34 of the Indian Penal Code.
The father of the victim made allegation that Chandan Kumar Bhagat kidnapped his daughter. Md. Anwarul Haque saw them going in a train.
Learned counsel for the petitioner submits that when the informant enquired from Raj Kumar Bhagat and Manorma Devi, Manorma Devi disclosed that her son had gone to the house of Santosh Kumar, the petitioner who happens to be maternal uncle of Chandan Kumar Bhagat. Except suspicion there appears no
Patna High Court Cr.Misc. No.50611 of 2014 (4) dt.04-05-2015 2/2 material to show that the petitioner ever helped his nephew Chandan Kumar Bhagat in kidnapping of the daughter of the informant.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jogbani (Bathnaha) P.S. Case No. 47 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
