1. Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mr. Umesh Lal Verma, learned APP for the State.
2. The petitioner seeks regular bail in connection with Bibhutipur P. S. Case No. 10 of 2024, dated 08.01.2024 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 380, 504 and 506/34 of the Indian Penal Code.
3. The main submissions advanced by the petitioner's counsel are that as per the FIR, the main allegation of assaulting the informant by means of sharp edged weapons is against the co-accused persons namely, Sitaram Jha and Rahul Kumar who
Patna High Court CR. MISC. No.39400 of 2025(2) dt.04-07-2025 2/3 have been enlarged on bail by the co-ordinate Bench of this court vide order dated 22.01.2025 passed in Cr. Misc. No. 80250 of 2025 and the petitioner's case stands on a better footing as he is simply alleged to have assaulted the informant by means of an iron rod on non-vital part of the body, i.e., his hand and the petitioner has been languishing in jail since 20.01.2025 and against him the investigation has been completed. It is further submitted that the alleged occurrence was not pre-planned as per the prosecution story and the same is said to have taken place on account of some dispute relating to Nal-Jal Scheme running in between both the parties.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the aforesaid submissions advanced by the petitioner's counsel and mainly petitioner's custody period and the grant of bail to the aforesaid two co-accused persons carrying more serious allegation than the petitioner and coupled with the completion of investigation against this petitioner, this court is inclined to grant him the relief of bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Bibhutipur P. S. Case No. 10 of 2024 on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of
