13-01-2016 Heard learned counsel for the petitioner learned counsel for the informant and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Dagarua P.S. Case no. 49/2015 registered for the offences punishable under Sections 147, 148, 149, 323, 324 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present case has been filed as there has been altercation between parties. There is case and counter case bearing Dagarua P.S. Case No. 65/2015.

It is further submitted that there is no specific allegation

Patna High Court Cr.Misc. No.28693 of 2015 (5) dt.13-01-2016 against these petitioners. Another similarly situated co-accused has been extended privilege of anticipatory bail in Cr. Misc. 29172/2015 vide order dated 28.07.2015.

Considering the afore-mentioned facts and circumstances and that the petitioners are similarly situated and have no criminal antecedent, let the petitioners, above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with Dagarua P.S. Case No. 49/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
