Petitioner seeks bail in a case registered under Sections 302, 120B/34 of Indian Penal Code.

Claiming parity with other co-accused, namely, Sonu Bhagat, Deepak Bhagat and Vikash Kumar @ Bhibhash Thakur @ Bhibhash Kumar @ Bikash Thakur, who have been allowed bail by this Court in Cr Misc No 2314 of 2018 and Cr Misc No 16649 of 2018 respectively, the petitioner has prayed for grant of bail. It is submitted that there is general and omnibus allegation and that there is no allegation against the petitioner. Petitioner is having no criminal antecedent prior to the instant case. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge III, Purnea in Sessions Trial Case No 396 of 2017/CIS No 396 of 2017 arising out of Dhamdaha Police Station Case No 38 of 2017 dated 01.03.2017 corresponding to GR Case No 703 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
