The petitioner seeks bail in Bhabhua P.S. Case No. 28/2015, registered for the offences punishable under Sections 467, 468, 471, 120B and other Sections of the Indian Penal Code. The informant earlier filed a complaint case bearing no. 1460(c)/2014, on the basis of which the present FIR is lodged. The informant alleged in the complaint petition that he came across with accused nos. 2 and 3, namely Ram Sewak Yadav and Birendra Kumar Bind (Petitioner), who disclosed that accused no. 1 Dhwani Agrawal holds some lands in village Saintha, P.S. Sonhan, District-Kaimur and the informant did not make any sorts of allegation against the petitioner about committing forgery. On same allegation Ram Sewak Yadav, co-accused has been granted anticipatory bail vide order dated 06.02.2017 passed in Cr. Misc.

Learned counsel for the informant vehemently opposed the prayer for bail, but on query about the allegations made against the petitioner in the complaint petition, he kept mum and could not be able to show any other allegation against the petitioner. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabhua) in connection with Bhabhua P.S. Case No. 28/2015.
