The petitioner is in custody in connection with Kanti P.S. Case No. 218 of 2020 (NDPS-24/20) for the offence under Sections 313 and 414 of the Indian Penal Code and Sections 8, 20(b)(ii)(c) and 22(c) of the Narcotic Drugs & Psychotropic Substances Act, 1985.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. In the instant case, 1 Kg of Ganja was recovered from the motorcycle of the petitioner by the police for which he did not produce the document of the vehicle.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.37168 of 2020(2) dt.02-02-2021 2/2 recovery of 1 Kg of Ganja is small quantity. Petitioner is in custody since 16.04.2020.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 16.04.2020, the Court is inclined to grant bail to him. Let petitioner, above-named, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judge, Muzaffarpur in connection with Kanti P.S.
