The petitioner is in custody since 14.06.2016, in connection with Bochaha P.S. Case No. 79 of 2016, registered for offences punishable under Sections 364 and 365/34 of Indian Penal Code.
Allegation against the petitioner, who is the father-in-law of the deceased is that he used to torture the victim girl and he forced the victim girl to leave the house and since then she has been traceless.
It has been submitted on behalf of the petitioner that petitioner is the father-in-law of the deceased and has no concern with the alleged offence. The petitioner has been languishing in judicial custody since 18.06.2016 without having any criminal

Learned Additional Public Prosecutor, appearing on behalf of the State, also could not point out any specific overt act against the petitioner.
Considering the aforementioned facts and circumstances, nature of offence, the period of custody and also the fact that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Bochaha P.S. Case No. 79 of 2016.
