The petitioner seeks bail in Sessions Trial No. 406 of 2015 arising out of Riga P.S. Case No. 149 of 2019, instituted for the offence under Section(s) 304(B) and 201 of Indian Penal Code.

It is alleged in the written report that marriage of daughter of the informant namely, Renu Devi was performed with this petitioner on 21.2.2007. After marriage, the inlaw's started making demand of she buffalo and cash of Rs.25,000/- for the purpose of business of fishing and on non-fulfillment of aforesaid demand they started torturing the daughter of the informant and ultimately killed her and cremated the dead body without giving information to the informant.

Patna High Court CR. MISC. No.36960 of 2019(2) dt.19-06-2019 2/3 Counsel for the petitioner submits that petitioner is not named in the written report. There is no allegation of any specific overt act against him. The Police after investigation did not submit charge sheet. Trial has proceeded against family members of the petitioner, but during trial the learned Magistrate has issued summon against the petitioner also to face trial under Section 319 Cr. P.C. Thereafter, petitioner surrendered in the court below on 7.5.2019 and till then he is in custody since 7.5.2019 having clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Sitamarhi, in connection with Sessions Trial No. 406 of 2015 arising out of Riga P.S. Case No.

(i) Petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court (ii) In absence on two consecutive dates without any valid reason, the bail
