JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2025 Heard learned counsel appearing on behalf of the petitioner, learned A.P.P. appearing on behalf of the State and learned senior counsel appearing on behalf of the informant.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 384, 386, 427, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, it is alleged that this petitioner demanded Rangdari of Rs. 10,00,000/- from the informant and on the point of pistol, took Rs. 10,000/- from the
Patna High Court CR. MISC. No.40009 of 2025(3) dt.19-09-2025 2/3 pocket of informant and damaged the boundary wall.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, a title suit bearing Title Suit No. 248 of 2022 is pending between the parties for a piece of land upon which the informant was making illegal construction and when the petitioner objected, a free fight took place between the parties. Charges have already been framed against this petitioner vide order dated 09.07.2025 and petitioner is in custody since 12.03.2025.
5. Learned A.P.P. for the State and learned senior counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation and period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in
