The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 324, 307, 504 and 34 of the Indian Penal Code. Allegation against petitioner is that he along with other accused persons came at the house of informant and petitioner shot fire arms at husband of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 30.5.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. No motive has been alleged against petitioner. Petitioner has been made accused because he happens to be brother-in-law of the brother of the victim. There is admitted property dispute between the victim and his brother. It is further submitted that petitioner may be released on bail after completion of seven months in custody, i.e., from 30.5.2016. On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.34493 of 2016 (3) dt.29-09-2016 2/2 above named petitioner be released on bail after completion of seven months in custody, i.e., from 30.5.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Ranvijay Kumar learned Additional Chief Judicial Magistrate-IV, Katihar, in connection with Katihar P.S. Case no. 443 of 2015.
