The petitioner, who is in custody, seeks bail in connection with Gaya Muffasil P.S.Case No. 534 of 2016 registered under Sections 279 and 304A of the Indian Penal Code and Section 37(a)(b)(c) of the Bihar Prohibition and Excise Act, 2016.

Allegation in brief is that the petitioner hit the nephew of the informant, aged about 08 years, who was standing in front of his house by the road side and as a result of injury, he died.

Learned counsel for the petitioner submits that the nephew of the informant suddenly crossed the road and met with an accident and the petitioner has a valid licence and he was not in

Patna High Court Cr.Misc. No.9255 of 2017 (2) dt.23-02-2017 2/2 drunken condition and has been in custody in this case since 16.12.2016.

Having considered the aforesaid facts and circumstances, the petitioner, namely Ranjan Kumar @ Ranjan Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Gaya Muffasil P.S.
