The petitioner seeks bail in connection with Bihiya P.S. Case No. 261 of 2017 registered for the offences punishable under Sections 366(A), 504/34 of the Indian Penal Code.

The allegation in the present case is regarding the petitioner having abducted the minor girl and committed rape on her.

The learned counsel for the petitioner submits that the petitioner is innocent and is languishing in custody since 12.12.2017.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.25840 of 2018 (3) dt.06-07-2018 2/2 case, the statement of the victim girl made under Section 164 Cr.P.C. as also the material available in the case diary, the complicity of the petitioner is writ large.

In such view of the matter, there is no merit in the present petition. Accordingly, the same is dismissed. (Mohit Kumar Shah, J) S.Sb/- U T
