2. The petitioner seeks bail in connection with Ladaniya P.S. Case No. 31 of 2024 registered for the offence under Sections 302/34 of the I.P.C. and Section 27 of Arms Act.
3. The petitioner is not named in the F.I.R. and is in custody since 10.03.2025.
4. As per FIR, 5 named co-accused persons committed murder of the husband of the informant by causing fire arm injury.
5. Mrs. Vaishnavi Singh, learned counsel appearing on behalf of the petitioner submitted that this petitioner was
Patna High Court CR. MISC. No.38413 of 2025(4) dt.28-11-2025 2/3 named out of statement of the witness Shiv Kr. Yadav, who found this petitioner with co-accused Vikash Kr. Yadav, running away through motorcycle after the occurrence where no incriminating material appears recovered/ surfaced during investigation as to connect this petitioner with present crime in question. Petitioner was not put on TIP as yet. It is submitted that similarly situated not named accused namely, Dharmeshwar Yadav, granted bail by one of the learned Coordinate Bench of this Court through Cr. Misc. No. 27151 of 2024 dated 26.07.2024. While concluding the argument, it is submitted that petitioner is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP opposes the prayer of bail.
7. In view of aforesaid factual submission and by taking note of fact as petitioner was not named in FIR and except suspicion as he found running with one of the coaccused after the occurrence nothing incriminating appears during investigation as to suggest prima-facie involvement of

No.38413 of 2025(4) dt.28-11-2025 3/3 this petitioner with present crime in question, coupled with fact that investigation of this case already completed where petitioner remains in custody since 10.03.2025, accordingly petitioner above named, is directed to be released on bail in connection with Ladaniya P.S. Case No. 31 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhubani /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
