This Criminal Miscellaneous has been filed against the order dated 05.06.2013 passed by the learned S.D.J.M. Nawada in Complaint Case No. 392 of 2013, whereby and whereunder, prima-facie case has been found to be made out under section 498 (A) of the I.P.C. and section 3⁄4 of the Dowry Prohibition Act.

Perused the impugned order. During enquiry three witnesses have been examined and after considering the materials available during enquiry the learned Magistrate has found primafacie case to be made out under section 498 (A) of the I.P.C. and

Patna High Court Cr.Misc. No.51840 of 2014 (2) dt.21-11-2017 2/2 section 3⁄4 of the Dowry Prohibition Act against the petitioner and others. In the impugned order there is no illegality, incorrectness or impropriety and as such the same does not require any interference by this Court.

In the result, finding no merit in this Criminal Miscellaneous, the same is hereby dismissed at the admission stage itself.
