JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2017 The learned trial court has reported that the case is pending for recording the defence evidence meaning thereby, the prosecution has already closed its evidence.
Earlier, the prayer for bail of the petitioner was twice rejected by this Court directing the trial court to dispose of the trial of the petitioner within certain period of time but, admittedly, uptil now, the trial of the petitioner could not be concluded. Again, the learned Additional Sessions Judge-II, Saharsa, has sought for two months time for disposal of the case.
Since all the prosecution witnesses appears to have already been examined and petitioner does not have any criminal antecedent, I think it proper to release the petitioner on bail and, accordingly, let the petitioner be released on bail on furnishing
