The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received about manufacture of liquor, it is stated that a raid was conducted and 115 litres of country liquor and 2400 kgs of mahua solution was recovered by the side of the railway line. The three accused persons including the petitioner herein were taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the

Patna High Court CR. MISC. No.49545 of 2021(2) dt.22-02-2022 2/2 case and arrested under a misunderstanding. He is in custody since 19.10.2020 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for 1 year 4 months and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with G.O. Case no. 251 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge II -cum- Special Judge, Nawada.
