The petitioners seek bail in N.T.P.C. P.S. Case No. 02/2016, registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Some electric wires were stolen and for that the case was lodged against unknown. During the course of investigation, one Gunjan Kumar Yadav was apprehended and from his possession electric wire was recovered. Gunjan Kumar Yadav is said to have disclosed the name of the petitioners, but nothing has been recovered from the possession of the petitioners. The petitioners are in jail since 18.01.2017.

Considering the facts aforesaid and the fact that nothing

Patna High Court Cr.Misc. No.12148 of 2017 (2) dt.20-03-2017 has been recovered from the possession of the petitioners and name of the petitioners figured in the confessional statement of Gunjan Kumar Yadav, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with N.T.P.C. P.S. Case No. 02/2016.
