The petitioner seeks regular bail in connection with Bakhtiarpur P.S. Case No. 160 of 2021 registered for the offence under Section 366(A) of the Indian Penal Code. Allegation against the petitioner is of abduction of victim daughter of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted that victim recovered and denied her abduction by the petitioner in her statement recorded under section 164 of Cr.P.C. rather she stated that she went along with the petitioner with her sweet will. A statement has been made in para 3 of the petition that the
Patna High Court CR. MISC. No.41060 of 2022(3) dt.04-01-2023 2/2 petitioner has got no criminal antecedent. The petitioner is languishing in judicial custody since 27.9.2022. Learned APP appearing for the state has vehemently opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bakhtiarpur P.S. Case No. 160 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-III, Barh, Patna.
