2. The petitioners are in custody in connection with Barahaiya P.S Case No. 53 of 2025 registered for the offences punishable under Sections 140(3) of the BNS.
3. As per prosecution story, petitioner along with co-
Patna High Court CR. MISC. No.40613 of 2025(3) dt.20-08-2025 2/3 accused have abducted the son of the informant.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that allegations against the petitioners are vague and omnibus in nature. It is further submitted that body of the informant's son was recovered on 17.03.2025 from a river which is distinct and away from the place where the petitioner was apprehended by Barhiya P.S patrol team. From the perusal of the death inquest report dated 17.03.2025 it appears that the injuries caused by electrical shock and spark were found on the body of the deceased and the cause of death is unclear. It is further submitted there are no eye witnesses of the alleged offence. No incriminating articles have been recovered from the conscious possession of the petitioner. It is also submitted that petitioners are in judicial custody since 18.03.2025 and they have got no criminal antecedent as stated in paragraph no. 3 of the bail petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioners.
6. Considering the aforesaid facts and circumstances of the case, materials available on record and submissions made on behalf of the petitioners, let the above named petitioners be
