Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302, 120(B) of Indian Penal Code and Section 27 of Arms Act.
As per FIR, this petitioner along with other accused persons shot dead the son of the informant. It is alleged that earlier this petitioner had inimical relation with the informant and her son.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Informant is not an eye witness of the occurrence and petitioner has been made accused only on the basis of suspicion. It is not even a case of last seen. It is next submitted that both
Patna High Court CR. MISC. No.42860 of 2022(2) dt.01-12-2022 2/2 parties are neighbours and due to old enmity he has been dragged into this case. Furthermore, similarly situated 3 coaccused persons have already been granted bail by this Hon'ble Court vide order dated 28.01.2022 passed in Cr. Misc. No. 22401 of 2021. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Samastipur in (Mufassil) Samastipur P. S. Case No. 89 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
