The petitioner seeks bail in a case registered under Sections 376 and 420 of the Indian Penal Code. Allegation against the petitioner is of establishing physical relationship with the victim on the false pretext of marriage. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 09-05-2019. It is alleged that on the false pretext of marriage, the petitioner established physical relationship with the victim. Later on, he refused to marry with the victim. Hence, the present case was instituted. On intervention of the well wishers, vide Annexure-3, the matter

Patna High Court CR. MISC. No.37780 of 2019(2) dt.21-06-2019 2/2 has already been settled with the condition that the petitioner will marry with the victim. The statement made on behalf of the petitioner has not been controverted by the counsel for the informant.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5th, Madhubani in connection with Basopatti P.S. Case No. 83 of 2019.
