JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,385,387,307 and 504/34 of the Indian Penal Code. It is alleged that the petitioners demanded extortion of rupees two lacs from the grand son of the informant and made indiscriminate firing.
It is submitted by the learned counsel for the petitioners that no injury was caused to any one and at earlier point of time the petitioner side lodged Matihani P.S. Case No. 67 of 2014 against the grand son of the informant under sections 447,385,387,307 and 506 IPC and section 27 of the Arms Act
Patna High Court Cr.Misc. No.26000 of 2015 (2) dt.01-07-2015 2/2 whereas another grand son of the informant was made accused in Matihani P.S. Case No. 66 of 2014 registered under sections 25(1B) A and 26 of the Arms Act where arms were recovered from the grand son of the informant at the behest of the petitioners. Considering the fact that the case was lodged by the petitioners side at earlier point of time and no injury was caused to the grand son of the informant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Begusarai in connection with Matihani P.S. Case No. 46 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
