The petitioner is in custody in connection with Alamganj P.S.Case No. 67 of 2017 registered under Section 394 of the Indian Penal Code, pending in the court of learned A.C.J.M., Patna City( Patna).

The allegation against the petitioner is that he snatched golden chain from the wife of the informant. The petitioner is named in the FIR. It has been submitted on behalf of the petitioner that he has falsely been implicated in the present case. It is further submitted that the petitioner is residing in same Mohalla and it is not probable that he will try to snatch the golden chain from his own Mohalla people and that too without hiding his face. The petitioner is in custody since 20.02.2017.

Patna High Court Cr.Misc. No.15234 of 2017 (3) dt.18-04-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail stating that he caught at the spot.

Having considered the submissions of both the sides and also in view of the fact that the petitioner caught at the spot, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, the trial court is directed to expedite the trial.
