JUSTICE MADHURESH PRASAD ORAL ORDER 26-04-2018 Heard counsel for the petitioner and the State. Petitioner, who is father-in-law of the deceased, is an accused in a case registered for offence under sections 304B/34 IPC.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and has been implicated in this case on the omnibus and general allegation. Reference is made to paragraph 11 of the case diary and it is submitted that prior to the lodging of the instant case in fact the petitioner in presence of police has lodged UD case and the body of the victim was handed over to the petitioner in presence of her parents. Considering the aforesaid submissions and the fact that the petitioner is in custody since 17.12.2017, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two

No.16580 of 2018 (3) dt.26-04-2018 sureties of the like amount each to the satisfaction of Sri G N Dubey, Judicial Magistrate, 1st class, Sherghati, Gaya in Gurua Police Station Case No. 161 of 2014 on the following grounds:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and (b) The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
