Petitioner seeks bail in Jay Nagar P.S. Case No.191 of 2019 instituted for the offence under Section(s) 272, 273/34 Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that police found five persons were coming from Nepal side with bag on their heads. Petitioner and another accused was arrested while others managed to run away after throwing the bags. It is alleged that 45 litres liquor has been recovered from bag of the petitioner and 180 litres liquor has been recovered from the bag of other accused persons. Counsel for the petitioner submits that Petitioner is in custody since 20.05.2019 having clean antecedents.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Excise Act, Madhubani, in connection with Jay Nagar P.S. Case No.191 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
