This application for anticipatory bail arises out of Siwan Town P.S. Case No. 195 of 2019, disclosing offences under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that today by an order passed in Cr. Misc.No. 38902 of 2019, some of the co-accused persons, namely, Bhola Kumar Agrahari, Anand Kumar Agrahari, and Rahul Kumar Agrahari have been allowed the privilege of anticipatory bail, though such prayer has been declined in respect of co-accused Vikki Kumar, who is said to have made an assault with a sword. He contends that

Patna High Court CR. MISC. No.39008 of 2019(2) dt.26-06-2019 2/2 the case of the petitioner cannot be distinguished from those, who have been allowed anticipatory bail by this Court. I find substance in the said submission of the learned counsel for the petitioners.

This application is accordingly allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned CJM, Siwan in Siwan Town P.S. Case No. 195 of 2019, subject to the condition as laid down under Section 438

(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
