JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 24-06-2015 By this Miscellaneous Application, learned counsel for the petitioners seeks indulgence of this Court for extending the period granted to the Arbitral Tribunal to decide the matter. This Court had fixed the outer limit by 25.05.2015, but, for various reasons the arbitrator could not finalise the matter.

Both the parties are represented and agreed that they would cooperate in the arbitral proceedings. It is hoped that they would conclude the proceedings well within time so that the final award may be passed. Considering the aforesaid, the time fixed by order of this Court dated 15.10.2014 passed in MJC No. 3726/2014 in respect of Request Case No. 4 of 2013 is extended by another six months from today subject to

Patna High Court MJC No.1285 of 2015 (2) dt.24-06-2015 additional remuneration payable to the Arbitrator of Rs. 4,00,000/- (Rupees Four Lacs ) as the Arbitrator was not at fault in delaying the proceedings.

The parties who were contesting the maintainability matter and the matter was delayed, as such, it is expected that both the parties fully cooperate in the proceedings and dispose of the matter expeditiously. This Modification Application, with the aforesaid stand, disposed of.
