This is a case registered under Sections 302, 120(B)/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that circumstances narrated in the FIR does not support the allegation against the petitioner as no external injury has been found on the body of the deceased to suggest that he has been done to death. Further it has been submitted that prior to the instant case the petitioner has no criminal antecedent and that no independent witness come forward to support the allegation during course of the investigation. Charge sheet has been submitted in this case and as such there is no chance of tampering with the witnesses. Petitioner is in jail

Patna High Court Cr.Misc. No.16626 of 2018 (3) dt.26-04-2018 2/2 custody since 22.11.2017 In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 6th, Saran at Chapra in Mashrak P.S. Case No. 263 of 2017, G.R. No. 6671 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
