1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Govindganj P.S. Case No. 102 of 2022 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that accused persons came and pressurized him to compromise the case which was filed against them earlier by him and on refusal, Md. Ali assaulted with farsa causing injury over nose, Badree assaulted by lathi causing injury on left arm and when family members came to save him, it is alleged that

Patna High Court CR. MISC. No.40784 of 2023(2) dt.03-08-2023 2/3 petitioner assaulted Jalaluddin by sword causing injury and tried to outrage the modesty of the female members and took away money and damaged the household articles.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that though it is alleged that the accused persons assaulted and petitioner assaulted Jalaluddin but then the nature of injuries suffered by Jalaluddin is simple in nature caused by hard and blunt substance, as would be evident from the order impugned itself, it is thus submitted that the assault by sword, as alleged against the petitioner, is not corroborated by the injury report.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Govindganj
