JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sugauli P.S. Case No. 291 of 2016 registered under sections 363 and 365 of the Indian Penal Code.

Accusation is that Puja Sah the daughter of the informant went out of the house and she did not return back. Thereafter, the informant came to know about the occurrence by SMS sent by his daughter in which she stated that she was kidnapped by accused Nazir Ansari (petitioner) and presently kept confined in a room Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.14276 of 2017 (3) dt.28-04-2017 2/2 submits that the petitioner is a Manager of Orchestra party and he has falsely been implicated in this case while victim has disclosed the name of the petitioner but she has not stated about ill behaviour at the hand of the petitioner.

It appears from perusal of the statement of the victim recorded under section 164 Cr.P.C. that while she left Howrah for going Midnipur with Vikash and Diya but she was taken at Muzaffarpur and on query made by her about coming to Muzaffarpur, they ignored the same and they took the victim at the house of the petitioner for getting money. Having considered the facts and circumstances the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected at this stage.
