JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 120 bottles, each containing 300 ml. country made Nepali liquor, total measuring 36 liters, were recovered, while the aforesaid bottles were being carried by the petitioner on a motorcycle.
Submission on behalf of the petitioner is that nothing was recovered from his conscious possession and, as a matter of fact, petitioner was caught on mere suspicion. Moreover, petitioner is in jail custody since 16.07.2016 and does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,
Patna High Court Cr.Misc. No.38768 of 2016 (2) dt.19-09-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,-II Araria in connection with Kursakanta ( Sonamani Godam) P.S.Case No. 108 of 2016, subject to condition that one of the sureties must be local and holder of landed property.
