JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught red handed while he was carrying 9 liters Nepali liquor, kept in 30 bottles, and for the aforesaid offence, petitioner is in jail custody since 02.07.2016. Petitioner does not have any criminal antecedent and submission on behalf of the petitioner is that he has been implicated in this case on mere suspicion.
Considering the period of detention of the petitioner in jail custody as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarahi in connection
