2. The petitioner has preferred this application for grant of regular bail in connection with Patna GRPS Case No. 433 of 2024 dated 23.06.2024 registered for the offences punishable under Sections 379 and 420 of the Indian Penal Code and Section 66D of Information and Technology Act.
3. As per the prosecution case, the informant alleged that on 22.06.2024, while he was waiting at Patna Junction for boarding a train, in the meantime, he went to assist a passenger. Upon returning, he found that his mobile phone, which contained two SIM cards, had been stolen. He informed his family about the incident using coach attendant's phone and

Further, on 23.06.2024, he withdrew Rs. 43,000 from his account. Thereafter, he discovered that his account balance had become zero. Upon inquiry, he came to know that his ICICI and HDFC Banck accounts had been defrauded of Rs. 87,000/- and Rs. 34,000/- respectively, due to cyber fraud.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has come in this case during the course of investigation. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 26.02.2025 in connection with Gandhi Maidan P.S. Case No. 56/2025 and he has been remanded in the present case 08.03.2025, since then he is in jail.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.38291 of 2025(4) dt.09-09-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Patna GRPS Case No. 433 of 2024, with following conditions:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled. (ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
