The petitioner seeks bail in anticipation of his arrest in connection with Kishanganj P.S. Case No. 129 of 2020 instituted for the offence under Section 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It has been submitted on behalf of the petitioner that the case was lodged at his instance but somehow or the other, he has been made accused in this case. However, regard being had to the criminal antecedents of the petitioner, I am not inclined to exercise

However, if the petitioner surrenders before the Court below and seeks bail, that petition shall be considered on its own merits, without being prejudiced by the fact that the present petition on his behalf has not been entertained.
