The petitioner has been in custody since 02.05.2019 in connection with Biraul P.S. Case No. 94/2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the recovery has been made from the jute bag and not from the conscious possession of the petitioner.

In view of the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District Judge 2nd Cum Special Judge (Excise), Darbhanga, in connection with
