The petitioner seeks bail in Belhar P.S. Case No. 204 of 2016 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The police apprehended two persons, namely, Balram Singh and Abhey Kumar @ Abhay Yadav (the petitioner), who after seeing the police, threw the bags containing arms. Learned counsel for the petitioner submits that one barrel of a double barrel gun with trigger, one barrel of a double barrel gun with trigger guard and other articles were recovered. Similarly situated coaccused Balram Singh has already been granted bail vide order dated 24.10.2016 passed in Cr. Misc. No. 35730/20167 by a coordinate bench of this Court.
