JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 23-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Dalsingsarai P.S. Case No. 10 of 2018 registered under Sections 379 and 461 of the Indian Penal Code.

Twenty one laptop and two external hard disk are said to have been stolen from the Kaushal Vikas Kendra by some unknown miscreants by breaking the lock of the centre and on the basis of the confessional statement of co-accused namely Baiju Kumar, one laptop of HP Company was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He has no concern

Patna High Court Cr.Misc. No.25967 of 2018 (3) dt.23-05-2018 2/2 with the aforesaid occurrence. He has been falsely implicated in the case due to dirty village politics. The laptop recovered from his house is hailing to him and moreover said laptop was not put on T.I.P. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring confessional statement of Baiju Kumar. The petitioner has no criminal antecedent. He has been languishing in custody since 07.02.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Samastipur camp at Dalsingsarai in connection with Dalsingsarai P.S. Case No. 10 of 2018.
