The petitioners have preferred this application for grant of regular bail in a case registered under sections 341, 323, 397, 436, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, it is stated by the informant that as a result of dispute relating to land, the matter had been settled by the Circle Officer in the Janta Darbar and the land had been demarcated by the Anchal Amin. It is further stated that the accused persons including the two petitioners herein as also their wives came and assaulted the informant and thereafter the two petitioners poured kerosene oil and lit the

Patna High Court CR. MISC. No.49531 of 2021(2) dt.21-02-2022 2/3 house of the informant on fire as a result of which the informant's house as also the house of the petitioners who are neighbours, got burnt down.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case because of land dispute between the parties which is evident from the F.I.R. itself. Further learned counsel for the petitioners takes the Court through the ordersheet of the cases/ litigations between the informant and the petitioners which have been brought on record as Annexure-3 series to the petition as also the F.I.R. which is Annexure-4 to the petition to show the enmity between the parties and also to falsify the statement made in the F.I.R. that the matter had been settled by the Circle Officer. The petitioners are in custody since 22.3.2021 and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has been brought on record by way of Annexure-3 series and Annexure-4 to the petition together with the petitioners having remained in custody for about11 months and investigation in the case having concluded, the Court directs both the petitioners to be enlarged on bail in

Patna High Court CR. MISC. No.49531 of 2021(2) dt.21-02-2022 3/3 connection with Pranpur P.S. Case no. 47 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st I/C, Katihar.
