Petitioner apprehends his arrest in a case registered under sections 406, 409, 467, 468, 420, 465 of the Indian Penal Code.
According to the F.I.R. allegation against the petitioner is that he was posted as Head clerk in the S.P. Office Vaishali and he was custodian of the service book and has committed forgery and cheating in his service book mentioning the name of second wife Parwati Devi after pasting the paper over the name of his first wife Meena Devi during his posting. It is submitted on behalf of the petitioner that petitioner has no criminal antecedent. It has further been
Patna High Court Cr.Misc. No.29546 of 2015 (2) dt.28-07-2015 2/2 submitted that for the similar allegation a departmental inquiry was initiated against the petitioner. The said enquiry report is annexure-4 to the present application and in course of the departmental enquiry the petitioner was exonerated from the said charges.
On behalf of the State it is submitted that petitioner is named in the first information report. Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Vaiishali at Hajipur in Hajipur town P.S. Case No. 1108 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
