JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Barauni (Chakia) P.S. Case No. 76 of 2016, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of Chief Judicial Magistrate, Begusarai. The accusation is that four persons named in the F.I.R. including the petitioner reached at the house of the informant, Gobind Bind, and made query about his son, Shivdani Bind. Thereafter, they started to take his son, Shivdani Bind, then informant also followed them. In the way, petitioner made complaint to his son that why cash of Rs.50,000/- was not paid as demanded. At that time, Anoj Singh, Jeeto Bind and Makhi Bind

Patna High Court Cr.Misc. No.8235 of 2017 (2) dt.15-03-2017 caught hold to his son, Shivdani Bind and this petitioner shot fire through Katta at Shivdani Bind, who died at spot. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to ulterior motive. Further submission is that petitioner is in custody since 08.04.2016.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
