The petitioner, who is in custody, seeks bail in connection with Ganga Bridge P.S.Case No. 95 of 2016 registered under Sections 376, 307, 201 and 323 of the Indian penal Code and Section 4 of the Protection of Children from Sexual Offences Act, 2012 Allegation in brief is that the son of the petitioner called the victim girl on the pretext to see his sister and when she went to his house, he locked her inside a room and committed rape and when she disclosed this fact to the petitioner, he threatened her and assaulted and threw her nearby a railway track and from there she called back to her father in the evening. It is submitted that whatever allegation of rape is

Patna High Court Cr.Misc. No.6745 of 2017 (2) dt.16-02-2017 2/2 levelled i.e., against the son of the petitioner and not against this petitioner. The only allegation is that when she disclosed this fact to the petitioner, he assaulted her, but no injury on the person of the informant's daughter has been found and he is in custody since 12.11.2016.

Having considered the aforesaid facts and circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 1st Addl. District and Sessions Judge-cum-Special Judge, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 95 of 2016.
