JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2017 The petitioner nos. 1 to 4 i.e. Jamuna Singh, Kamlesh Singh, Subhash Singh and Dharmendra Singh have already surrendered. Hence, their prayer for anticipatory bail is infructuous.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner no.5 i.e.

Akhilesh Singh is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 504 and 354(c) of the Indian Penal Code.

Specific allegation of giving dagger blow on the

Patna High Court Cr.Misc. No.26579 of 2015 (3) dt.18-03-2017 chest of Kaushal Singh is against co-accused Bhim Singh. There is general and omnibus allegation of assault against the petitioner Akhilesh Singh with lathi.

Submission of the petitioner is that co-accused Girija Singh has already been allowed anticipatory bail by a coordinate Bench of this Court by order dated 13.12.2016 passed in Cr.Misc.No. 47954 of 2016.

Considering the aforesaid facts, let the petitioner Akhilesh Singh, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Masaurhi at Patna/Successor Court in connection with Pipra P.S. Case No.41 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
