The petitioner seeks bail in Special Excise Case No. 3438 of 2019 arising out of Barh P.S. Case No. 163 of 2019, instituted for the offence under Section(s) 147, 148, 149, 307, 353, 120B, 323 of the Indian Penal Code, Sections 25(1b)A, 26, 27, 35 of Arms Act, Sections 30(A), 38 and 41 of Bihar Prohibtion & Excise (Amendment) Act, 2016. Counsel for the petitioner submits that no firearm has been recovered from possession of the petitioner. From seizure list it appears that total 7.125 litres of foreign liquor and 33.5 litres of Beer have been recovered from possession of the petitioner.

Petitioner is in custody since 30.3.2019 having clean

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Excise Case No. 3438 of 2019 arising out of Barh P.S. Case No. 163 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
