JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 127 of 2017, dated 20.05.2017, instituted for the offence punishable under Section 392 of the Indian Penal Code.

The informant is alleged to have been divested of Rs. 1,20,000/- on gun point by unknown miscreants. Neither the petitioner has been named in the First Information Report nor he has been put on Test Identification Parade. Nothing has also been recovered from the possession of the petitioner.

Learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.26520 of 2018 (3) dt.18-05-2018 2/2 that because of the earlier implication of the petitioner in two cases of similar nature, he was arrested in the present case and was made to make incriminating statement against himself. The petitioner, it has been submitted, has not made any confession before the police and only because of his past conducts; he has been arrested in the present case. Regard being had to the aforesaid facts and the period of custody of the petitioner which is from 15.11.2017, he is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Bhojpur at Ara in connection with Jagdishpur P.S.
