JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section395 of the Indian Penal Code. It would appear from perusal of the impugned order that except confessional statement of the petitioner and other accused, there is nothing against the petitioner. The petitioner is languishing in jail custody since 26-05-2016 but it appears that uptill now, the investigating officer did not take pain to arrange test identification parade. Moreover, having more or less similar allegation, one co-accused namely, Rajesh Kumar Yadav has already been granted privilege of bail by a coordinate bench of this court.
Patna High Court Cr.Misc. No.40371 of 2016 (2) dt.28-09-2016 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sherghati (Dobhi) P.S.
