Petitioner, already in custody, seeks bail in connection with Madhuban PS Case No.18 of 2014, registered under Section 307 of the Indian Penal Code as well as under Section 27 of the Arms Act.

It is submitted that the FIR is against unknown and the petitioner has been made accused in this case only on the basis of confessional statement of one co-accused Manoj Singh but leading to the confessional statement, no material evidence has been collected against the petitioner and investigation has been completed, trial is proceeding, the petitioner is in custody for last one year and similarly situated other co-accused, namely, Sanni Singh, Dipu Singh, Dipak Singh and Amit Singh

Patna High Court Cr.Misc. No.12774 of 2018(5) dt.26-04-2018 2/2 have been admitted to bail by co-ordinate Benches of this Court vide Cr. Misc. Nos.14325 of 2015 and 16921 of 2015 on 10.04.2015 and 22.06.2015 respectively.

Having considered the aforesaid facts and circumstances, petitioner Sudhir Singh @ Sudhir Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 4th, Motihari, East Champaran in connection with Madhuban PS Case No.18 of 2014, giving rise to Sessions Trial No.1151 of 2017 with the following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled. (Arun Kumar, J) S.KUMAR/- U T
